Decree No. 2015-1437 of November 5, 2015 establishing the list of supporting documents that may be requested from the rental candidate and their deposit

Article 1

I. - The list of supporting documents, provided for in article 22-2 of the aforementioned law of July 6, 1989, which may be required by the lessor of each of the rental candidates appears in appendix 1.

These provisions do not apply to requests for the allocation of social housing mentioned in Article L. 441-1 of the Construction and Housing Code.

II. - The list of supporting documents, provided for in article 22-2 of the aforementioned law of July 6, 1989, which may be required by the lessor of the candidate's deposits for rental appears in appendix 2.

III. - The documents produced may be copies of the original documents. They are written or translated into French and the amounts entered converted into euros. The original documents must be able to be presented at the lessor's request.

LIST OF SUPPORTING DOCUMENTS THAT MAY BE REQUIRED FROM EACH RENTAL APPLICANT

A. - A valid proof of identity, including the photograph of the holder among the following documents:

1. French or foreign national identity card.

2. French or foreign passport.

3. French or foreign driving license.

4. Document justifying the foreign rental candidate's right to stay, in particular, temporary residence card, resident card, national card of a member state of the European Union or the European Economic Area.

B. - A single proof of address from the following documents:

1. Three last rent receipts or, failing that, certificate from the previous lessor, or his agent, indicating that the tenant is up to date with his rents and charges.

2. Certificate of choice of address establishing the link with an organization approved under Article L. 264-2 of the Social Action and Families Code.

3. Certificate on the honor of the host indicating that the candidate for rental resides at his home.

4. Latest property tax notice or, failing that, title deed to the main residence.

C. - One or more documents attesting to professional activities among the following documents:

1. Employment or internship contract or, failing that, a certificate from the employer specifying the job and remuneration proposed, the planned date of entry into the position and, where applicable, the duration of the trial period .

2. Extract K or K bis from the trade and companies register less than three months old for a commercial enterprise.

3. The original extract D 1 from the trade register less than three months old for a craftsman.

4. Copy of the INSEE identification certificate, including identification numbers, for a self-employed worker.

5. Copy of the professional card for a liberal profession.

6. Any recent document attesting to the activity for other professionals.

7. Student card or school certificate for the current year.

D. - One or more documents attesting to resources among the following documents:

1. The last or penultimate notice of taxation or non-taxation and, when all or part of the income received has not been taxed in France but in another State or territory, the last or penultimate notice of imposition of the tax or taxes which take the place of income tax in that State or territory or a document in lieu thereof drawn up by the tax authorities of that State or territory.

2. Last three pay slips.

3. Proof of payment of internship compensation.

4. The last two balance sheets or, failing that, a certificate of resources for the current financial year issued by an accountant for self-employed professions.

5. Proof of payment of compensation, retirements, pensions, social and family benefits and allowances received during the last three months or proof of entitlement, established by the paying agency.

6. Simulation certificate established by the paying agency or simulation established by the tenant relating to housing assistance.

7. Notice of scholarship award for scholarship students.

8. Title to real estate or last property tax notice.

9. Proof of land income, life annuities or income from securities and movable capital.

LIST OF SUPPORTING DOCUMENTS THAT MAY BE REQUIRED FOR THEIR DEPOSITS

A. - For natural person guarantees, a valid proof of identity, including the photograph of the holder among the following documents:

1. French or foreign national identity card;

2. French or foreign passport;

3. French or foreign driving license;

B. - For legal entity guarantees, the two supporting documents:

1. Original K bis extract of less than three months from the company or the statutes or any other document justifying the legal existence of the person, showing the name of the person responsible and the address of the organization as well as proof that a declaration has been made to an administration, a court or a professional body.

2. Proof of identity of the representative of the legal entity appearing on the K bis extract or the statutes.

C. - A single proof of address from the following documents:

1. Last rent receipt.

2. Water, gas or electricity bill less than three months old.

3. Housing insurance certificate less than three months old.

4. Latest property tax notice or, failing that, title deed to the main residence.

D. - One or more documents attesting to professional activities among the following documents:

1. Employment or internship contract or, failing that, a certificate from the employer specifying the employment and remuneration proposed, the planned date of entry into service and, where applicable, the duration of the trial period.

2. Extract K or K bis from the trade and companies register dating from less than three months for a commercial enterprise.

3. The original extract D 1 from the trade register less than three months old for a craftsman.

4. Copy of the INSEE identification certificate, including identification numbers, for a self-employed worker.

5. Copy of the professional card for a liberal profession.

6. Any recent document attesting to the activity for other professionals.

E. - One or more documents attesting to resources among the following documents:

1. Last notice of taxation or non-taxation and, when all or part of the income received has not been taxed in France but in another State or territory, the last notice of imposition of tax or taxes which are in lieu of income tax in that State or Territory or a document in lieu thereof issued by the tax authority of that State or Territory.

2. Title to real estate or last property tax notice.

3. Last three pay slips.

4. The last two balance sheets or, failing that, a certificate of resources for the current financial year issued by an accountant for self-employed professions.

5. Proof of payment of compensation, retirement, pensions, social and family benefits and allowances received during the last three months or proof of entitlement, established by the paying agency.

6. Proof of land income, life annuities or income from securities and movable capital.

The RIB or IBAN can be requested to allow a bank direct debit to be set up but cannot be required. It is also not a mandatory document in the application file in accordance with the regulations.
